Please read these Terms and Conditions ("Terms") carefully before using the Everty.ai platform, website, or mobile application (collectively, the "Service"). By creating an account, accessing the Service, or clicking "I Agree," you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.
If you do not agree to these Terms, you may not use the Service.
1.1 You must be at least 18 years of age to use the Service. By registering, you represent and warrant that you are 18 years of age or older. We do not knowingly allow persons under 18 to create accounts or access the Service.
1.2 You must provide accurate, complete, and current information during registration and keep that information up to date.
1.3 You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@everty.ai if you suspect unauthorised access.
1.4 We reserve the right to refuse registration or suspend an account at our sole discretion.
2.1 The Service is offered on a freemium basis. The free tier provides limited access. Paid subscription plans ("Plus" and "Premium") unlock additional features and usage limits as described on our pricing page.

2.4 All fees are charged in EUR and processed through Stripe. By subscribing, you authorise us to charge your payment method on a recurring monthly basis until you cancel.
2.5 Trial period. New accounts automatically receive a 3-day Plus trial at no charge. At the end of the trial period, your account will automatically transition to the paid Plus subscription at €14.99/month unless you cancel before the trial ends. You will receive a reminder notification, including the charge amount of €14.99, before the trial expires.
2.6 Cancellation. You may cancel your subscription at any time via the Subscription settings page. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months, except as required by applicable law.
2.7 Fair-use throttling. To protect service quality for all users, messages above 40 per day (for both Plus and Premium subscribers) may be served by a lower-cost AI model. Sustained high-volume usage over a rolling 7-day window may result in a rate limit of 30 seconds between messages. Usage patterns that exceed these thresholds are subject to administrative review. This clause does not constitute a reduction in the service level advertised.
2.8 We reserve the right to modify pricing with 30 days' written notice to registered users. Your continued use of the Service after the effective date of a price change constitutes acceptance of the new pricing.
3.1 Everty Credits are a virtual currency used within the Service. Credits have no cash value and may not be transferred, sold, or exchanged for real currency, except as expressly described in clause 5 (Creator Monetisation).

3.4 Purchased credits (acquired via credit pack purchase) bypass monthly allocation caps. Earned credits (from subscriptions, achievements, referrals, or other rewards) are subject to caps described in clause 3.2.
3.5 Credits have no expiry provided your account remains active. Credits are forfeited if your account is terminated for a breach of these Terms.
3.6 We reserve the right to adjust the Everty Credits economy, earning rates, spending costs, and caps with reasonable notice.
4.1 You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
4.2 We reserve the right to remove content and suspend or terminate accounts that violate this clause, without prior notice and without refund.
5.1 Creator Programme. The Service allows users ("Creators") to publish characters and unlock them for other users in exchange for Everty Credits. Creators receive 70% of the unlock price as tip tokens, and the platform retains 30%.
5.2 Tipping. Users (Plus and Premium subscribers only) may tip Creators by spending 10 Everty Credits per tip. Each tip converts to 1 tip token credited to the Creator's tip balance. A user may tip the same Creator a maximum of once per day. Users may not tip themselves.
5.3 Tip Token Redemption. Tip tokens may be redeemed for cash payment via Stripe Connect at a rate of €0.10 per token (10 tokens = €1.00). The minimum payout threshold is 100 tip tokens (€10.00). Payouts are processed via Stripe Transfer to the Creator's verified Stripe Connect Express account in EUR. To receive payouts, Creators must complete Stripe Connect Express onboarding and satisfy all identity verification requirements imposed by Stripe. Everty.ai is not responsible for delays or failures in identity verification. Tip token earnings may be held for a reserve period of up to 14 days before becoming payout-eligible. This reserve protects against chargebacks and fraud. Everty.ai reserves the right to withhold or reverse tip token earnings if the underlying transaction is subject to a chargeback, refund, or fraud claim.
5.4 NSFW Characters. Characters with explicit content enabled (NSFW-enabled characters) may not be designated as premium characters (paywall-gated for credit unlocks) under any circumstances. This restriction is enforced at the platform level and cannot be overridden. Creator accounts that attempt to circumvent this restriction will be suspended.
5.5 Creator Tier Recognition. Creators are assigned a visible tier (0–4) based on their activity: publishing public characters, designating premium characters, and accumulating unlocks. Tier assignment is automatic and confers no contractual rights or guarantees of income. Tier thresholds may be adjusted by Everty.ai with notice.
5.6 Tax Obligations. Creators are solely responsible for reporting and paying any applicable taxes on earnings received through the Service. Everty.ai does not withhold taxes on Creator payments. You may receive a tax information request from Stripe depending on your jurisdiction and earnings level.
6.1 User-Created Content. Characters, universes, backstories, and other creative content you create on the Service ("User Content") remain your intellectual property. Everty.ai does not claim ownership, copyright, or intellectual property rights over your User Content.
6.2 Platform Licence. By publishing User Content as public or premium, you grant Everty.ai a limited, non-exclusive, royalty-free, worldwide licence to display, index, distribute, and serve that User Content to other users of the Service for the purpose of operating the Service. This licence does not transfer ownership and does not permit Everty.ai to sell, sublicense, or commercialise your User Content independently of the Service. You may withdraw this licence at any time by making the relevant character or universe private or by deleting it.
6.3 AI-Generated Outputs. Messages, images, and other content generated by the AI in response to your interactions are produced dynamically and are provided for your personal, non-commercial use within the Service. You may not distribute, sell, or commercially exploit AI-generated outputs without our prior written consent. We do not represent that AI-generated outputs are original or that their use is free from third-party intellectual property claims.
6.4 Third-Party Intellectual Property. You may create characters inspired by third-party intellectual property (fictional universes, franchises, or licensed characters). You are solely responsible for ensuring that your User Content does not infringe third-party intellectual property rights. Everty.ai does not screen User Content for IP compliance prior to publication. Characters based on real, living people are prohibited regardless of fictional framing (see clause 4.1).
6.5 DMCA Takedown Process. If you believe that User Content on the Service infringes your intellectual property rights, please submit a written notice to: legal@everty.ai. Your notice must include: (i) identification of the copyrighted work; (ii) identification of the infringing content and its location on the Service; (iii) your contact information; (iv) a statement of good faith belief; and (v) a statement of accuracy under penalty of perjury. Upon receipt of a valid notice, we will review and, where appropriate, remove the infringing content. We operate under the DMCA safe harbour provisions of the Digital Millennium Copyright Act and equivalent provisions under applicable EU law.
7.1 The AI characters on the Service are artificial intelligence systems. They are not real people, do not have genuine emotions, memories, or consciousness, and are not a substitute for human relationships or professional support (psychological, medical, legal, or otherwise).
7.2 The memory, mood, relationship progression, and personality features are technical simulations designed to create an engaging user experience. They do not represent actual sentiment or attachment on the part of the AI.
7.3 If you are experiencing a mental health crisis, please contact a qualified healthcare professional or a crisis support service in your region. The Service includes crisis detection features that may surface support resources; these are provided for informational purposes only and do not constitute clinical advice.
7.4 AI-generated content may be inaccurate, inconsistent, or unexpected. We do not warrant the accuracy, completeness, or appropriateness of any AI-generated output.
7.5 The Service uses Claude (Anthropic), Mistral, and other third-party AI providers. Availability and quality of the Service may be affected by third-party provider outages, policy changes, or pricing changes beyond our control.
8.1 Our collection, use, and protection of your personal data is described in our Privacy Policy, available at everty.ai/privacy. By using the Service, you consent to our data practices as described in the Privacy Policy.
8.2 Conversation content (messages, character interactions, memory data) is processed by third-party AI providers (including Anthropic and Mistral) subject to their respective privacy policies and data processing terms. By using the Service, you acknowledge and consent to this processing.
8.3 You may request deletion of your account and associated personal data at any time via Settings → Account → Delete Account. Upon deletion, your private characters and conversations will be deleted. Your public characters will be transferred to the platform administrator account rather than deleted, to maintain service continuity for users who have unlocked or interacted with those characters.
9.1 The following content is strictly prohibited on the Service regardless of the account tier or explicit content settings:
9.2 Explicit (NSFW) content is available on Plus and Premium tiers for users who have verified they are 18 or over. Explicit content is routed to a separate AI model and is governed by additional content guidelines. The following are prohibited even within explicit content: any content that sexualises or romanticises minors; non-consensual scenarios presented approvingly; real individuals depicted in sexual scenarios without documented consent.
9.3 We reserve the right to remove prohibited content and suspend accounts without notice or refund. Serious violations may be reported to law enforcement.
10.1 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10.2 WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, APPROPRIATE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.
10.3 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EVERTY.AI'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU TO EVERTY.AI IN THE 12 MONTHS PRECEDING THE CLAIM; OR (B) €100.
10.4 IN NO EVENT SHALL EVERTY.AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10.5 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
You agree to indemnify, defend, and hold harmless Everty.ai, its officers, directors, employees, and agents from and against any claims, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from: (i) your use of the Service; (ii) your User Content; (iii) your violation of these Terms; or (iv) your violation of any third-party intellectual property or other rights.
12.1 We may suspend or terminate your account and access to the Service at any time, with or without notice, if we determine in our sole discretion that you have violated these Terms or that your use poses a risk to the Service or other users.
12.2 You may terminate your account at any time via Settings → Account → Delete Account.
12.3 Upon termination: (i) your right to use the Service ceases immediately; (ii) any unused subscription days are forfeited; (iii) Everty Credits are forfeited; (iv) outstanding tip token balances above the minimum payout threshold will be paid out to a verified Stripe Connect account if one exists; and (v) your User Content is handled as described in clause 8.3.
13.1 These Terms are governed by and construed in accordance with the laws of Ireland, without regard to conflict of law principles.
13.2 For users in the European Union: if you are an EU consumer, you retain the protections afforded to you by the mandatory consumer protection laws of your country of residence. Nothing in these Terms affects your statutory consumer rights.
13.3 Disputes. We encourage you to contact us at support@everty.ai in the first instance. If a dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the courts of Ireland, subject to any mandatory consumer dispute resolution mechanisms applicable in your jurisdiction.
13.4 EU Online Dispute Resolution. If you are an EU consumer, you may use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
We may update these Terms from time to time. If we make material changes, we will notify you by email or via an in-app announcement at least 14 days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and may terminate your account as described in clause 12.2.
15.1 Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Everty.ai with respect to the Service and supersede all prior agreements.
15.2 Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
15.3 No Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
15.4 Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
15.5 Language. These Terms are provided in English. In the event of any conflict between a translated version and the English version, the English version shall prevail.
